Privacy Policy

Introduction

Robyn and Megan Barton, of Barton Creative Co. are the sole owners and operators of the bartoncreative.co website. Our privacy policies exist to inform you of the collection, use and disclosure of personal information when you use our website. We will not use or share your information with anyone except as described in this Privacy Policy. We use your personal information for providing and improving our website. By using our website, you agree to the collection and use of information in accordance with this policy.

Information Collection and Use

While using our website, you may be prompted to share certain personally identifiable information that can be used to contact or identify you. This may include, but is not limited to, your email address, name, address, or phone number.

This information is voluntarily provided and is used only as it relates to our services. For example:

  • If you purchase a product or service from us, we will use your information to contact you and provide the product or service.
  • If you book a consultation with us, your information will be used so that we know who you are and how to contact you.
  • If you sign up for our email newsletter, your information will be used so that we can email you.
  • If you email us, we will use the information you share with us to respond to you.

We do not sell any information provided to us. We do not share your information with any third party outside of our organization, unless explicit permission is provided. For example:

  • If you book a consultation with us, your information will be stored within our scheduling service provider.
  • If you sign up for our email newsletter, the information you shared will be contained within our email service provider.
  • If you book a service with us, we will use the information you provide in our invoicing software provider.

Your Rights

You have the right to opt out of contact with us at any time. You can do this by clicking Unsubscribe in any of our email newsletters. You can also do the following at any time by contacting us via email or our contact page on this website:

  • See what data we have about you, if any.
  • Change or correct said data.
  • Have us delete any data we have about you.
  • Express any concern you have about use of your data.

No, not the kind of cookies you can eat (we wish). Cookies are small data files which may include an anonymous unique identifier. If you consent to use our website, our website may retrieve these cookies from your web browser (for example Safari or Google Chrome) each time you visit, so it can recognize you, remember your preferences, and provide you with a more secure online experience. We use these cookies to collect information. You can instruct your browser to refuse all cookies, or to indicate when a cookie is being sent. Occasionally, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We have no responsibility or liability for the content and activities of our site and welcome any feedback about these sites in order to improve your user experience.

Legal Compliance

We will disclose your personal information where required to do so by law, in accordance with an order of a court of competent jurisdiction, if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement, or to protect the security or integrity of our website.

Your Security

    The security of your personal information is important to us and we take precautions to protect your information. Whenever we collect sensitive information, that information is encrypted and transmitted to us securely. You can verify this by looking for a closed lock icon in your web browser, or by looking for "https" at the beginning our web address. We do not store financial information such as credit card numbers on our website, though you may be provided the opportunity to have your information securely stored via cookies or through one of our payment providers, like Paypal. Offline, we restrict access to your information only to employees of Barton Creative Co. Our personal computers and accounts are kept in secure locations and are only accessed by ourselves. 

    Children's Privacy

    Our website does not address anyone under the age of 13 and we do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with personally identifiable information, please get in touch and we will remove any such information from our systems.

    Changes to this Policy

    We may update our policy from time to time. We will notify you of these changes by updating them to this page, or by emailing you if you are on our mailing list. You are advised to review this policy periodically for changes


    General Policies

    Our Turnaround Time

    We pride ourselves on our efficiency. We are happy to provide estimated time frames, and ask that you please get in touch, as soon as possible, if you have a set deadline. If you require your project much sooner than our standard timeline, we may sometimes offer a 25% rush fee. This will only happen when accommodating your project requires us to push other projects back in order to accommodate yours. You are free to accept or decline. The time frame that we provide assumes prompt communication during the project (same or next day).

    Your Responsibilities

    All designs provided are based on the information you provide in our client questionnaire, and in consultation. All designs are created from scratch based on that information, and our market research and expertise. We reserve the right to halt a project and request that you reevaluate if we feel that the project has deviated too far from the original concept. No reference designs will be copied. It is your responsibility to ensure that your business name is cleared, and that your logo and branding do not bear similarity to the branding of similarly named businesses or related industries, however we will share our concerns if anything pops up during our market research. It is your responsibility to ensure that any materials provided for use with our services, including imagery, text, or audio, are copyright and royalty free, or otherwise appropriately licensed. You agree to fully indemnify and hold Barton Creative Co. free from harm and all claims resulting from you not having obtained any required copyright or other necessary permissions.

    Payment Policy

    Upon completion of a project, you will be invoiced for the remaining 50% of our fees, plus any tracked time on mutually agreed upon add ons. We offer a 30 day payment window from the date of invoicing. Within our invoice, you will have the option to pay by credit card or visa debit. We also accept Paypal payments or e-transfers to hello@bartoncreative.co. Where previously agreed upon, we will also accept cheques. Please note that returned cheques will result in a fee of $50.

    Ongoing clients will be charged hourly ($55 an hour) or quoted flat fee, depending on the service requested, and invoiced at month end. Invoices which remain outstanding after 60 days will incur late payment interest charges of 10% per month on the balance overdue. We will provide payment reminders after 30 days, 45 days, and 60 days. If an unforeseen situation arises, please reach out as soon as possible, and we can likely accommodate you. We reserve the right to involve a third party collection agency after 90 days in default. Clients in default agree to pay all reasonable legal fees, expenses, and third party collection agency fees upon enforcement.

    Communication Policy

    We respond to our emails within two business days, and faster for active projects. We ask that you please be respectful of our time. We carefully schedule our work and client projects to ensure that we are giving your brand our very best. Any open project, in which 60 days have passed without communication from a client will be marked as archived and any outstanding services will be invoiced for. If you need more time, or need to put your project on hold, simply let us know via email. If you would like to resume a project after a major communication lapse, we will move forward once your invoice is up-to-date. 

    Deposit + Refund Policy

    We will accommodate your request for a full refund up until the point that we've received your completed client questionnaire. All of our packages involve hours of research and work prior to beginning your design. As a result, 50% of our total fee, unless otherwise stated, is a non-refundable deposit. If you have received finalized files from us, your project is no longer eligible for a refund. We ask that you please take the time to review your questionnaire before submission. The more thorough and thoughtful your answers, the greater our ability to provide designs and strategy that align with your vision and needs.

    Copyright Policy

    Copyright release is available only after we have received payment in full for our services. When a copyright is released, we retain the right to display our designs in our portfolios and on our social media. We also retain full rights to our intellectual property, including our original source files, and any concepts not chosen. We will supply proofs, PDFs, and other files as appropriate for printing, or as otherwise requested within reason. We are happy to work with you if you require edits or changes to an original file at our standard hourly rate. If you require a full copyright release for said files to be modified by an in-house or other designer, this is subject to a new quote and buy-out fee. Copyright release does not include fonts. We include your font details, however, fonts must be purchased with appropriate licensing for legal reasons.

    Updates

    Our policies may change from time to time and all updates will be posted to this page. Any major updates will also be emailed to our mailing list. If you would like to subscribe to our mailing list, you can do so here.


    Brand Policies

    General Branding Policy

    Our branding packages include a specific number of revision rounds. Revisions are minor alterations, and do not include new proofs. Revisions may include a font or colour change, or the moving or resizing of an element. Additional revision requests may result in an additional charge of $25 per round, or your project being converted to an hourly rate. 

    Our Revision Policy

    If, at any time during your project, we determine that your requests are outside of the original scope that you've paid for, we will provide written notice of our recommendation that your order be transferred to our hourly rate. We will convert any existing payments to credit based on said rate, and will invoice for the remainder of our time.  This may include excessive requests for revisions, changes to finalized files, or requests to completely re-design a project from what was previously discussed. This is to ensure fair compensation for our time.

    Our Questionaire Process

    Our client questionnaire is a key piece of our branding process and workflow and includes important questions that collect the insights we need to craft your perfect brand. We will not begin work on your project until we have received a fully completed questionnaire. If you have any questions or require help on your brand questionnaire, please don't hesitate to reach out to us.

    Client Modification of a Design

    With the exception of our social graphic templates, we do not provide layered or editable design files. We spend a lot of time, and work very hard, to build and maintain our experience and expertise to ensure that we deliver you a high-quality final design that meets both of our standards. We ask that you please not modify design files that you are provided with. We provide multiple variations of your final design file, where applicable, and are happy to assist you with any tweaks or changes you need along the way.


    Web Policies

    Platform Policy

    After many years of working with other platforms, we now choose to work almost exclusively with Squarespace due to it's extremely user friendly, all-inclusive, design. Amongst many other features, this means that your website security, analytics, blogging, and e-commerce are all built in and that you will be able to easily navigate and manage your own website. We also provide a secret password-protected page with video tutorials and are happy to add more as the need arises. One thing that our clients appreciate most is that they don't have to worry about performing frequent updates, and have peace of mind that their website security is being managed by Squarespace. Squarespace has a solid reputation for uptime (99.9%) and amazing customer service. When you add up the additional add-ons that Wordpress needs to offer that functionality, Squarespace's fees are well worth it. Additionally, as Squarespace Circle Members, we are able to offer you a 20% discount on new annual plans.

    Websites + Content

    Website design packages do not include content, though we are happy to provide a quote if you are interested in any imagery (aside from included design elements) or curated stock photos. We also offer copywriting or copyediting at our hourly rate. All of these components work together to ensure that your website functions at its highest potential. Unless you are moving forward with our content curation, we ask that you please try to have your content ready before moving forward with a web project. We will use placeholder content in the meantime, however the top barrier to our quick turnaround is usually related to content not being ready.

    For web projects that surpass the original agreed upon time frame, we will provide notice that we are switching you to our hourly pricing. We will provide a credit for any existing payments and will provide month-end invoices until project completion so that we are fairly compensated for our time. If you have all of your content ready, and keep up your end of communication, we guarantee the time frame and final price as quoted in your customized web proposal. We allow minor changes (text or placement) within 14 days of launch. After that time period, we are happy to perform any updates or maintenance to your website at our standard hourly rate.
